01 · Section

Introduction

Welcome to BitPulse (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the BitPulse platform, including our website, mobile applications, and services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.

BitPulse is a platform that facilitates the buying and selling of USDT (Tether, a US dollar–pegged stablecoin) using Mobile Money services in Ghana. Please read these Terms carefully before using our Service.

02 · Section

Acceptance of Terms

By creating an account, accessing, or using BitPulse, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Service. By using BitPulse, you represent and warrant that you meet these requirements.

03 · Section

Account registration and security

3.1 Account creation

To use our Service you create an account with an email address and a password. A phone number is not required at registration; you may add one later under Settings if you want SMS notifications or to use Mobile Money as a payment method. You must provide accurate, current, and complete information, and update it if it changes.

You agree that you have the legal authority to use the email address you provide and that you are the same person across any accounts you maintain with us. We do not permit multiple accounts per person except where explicitly authorised by us in writing.

3.2 Account security

You agree to:

  • Use a strong, unique password (we enforce a minimum of 8 characters including upper case, lower case, and digits, and we reject passwords known to have appeared in public credential breaches).
  • Enable two-factor authentication (2FA) as soon as you start trading meaningful amounts.
  • Keep your password and 2FA backup codes confidential and not share account credentials with anyone.
  • Notify us immediately at support@bitpulsegh.com if you suspect unauthorised access.
  • Log out when using shared or public devices.

We secure your side of the account with email-OTP login confirmation, optional TOTP two-factor authentication with recovery codes, new-device and new-country login alerts, and a temporary 24-hour cool-down on the first send to any new crypto withdrawal address (see ‘Withdrawal address security’ below).

3.3 Identity verification

You must verify your email address and complete Know Your Customer (KYC) verification before any transaction. KYC requires you to submit photographs of a government-issued ID (Ghana Card, passport, or driver’s licence), a current selfie, and your full legal name exactly as it appears on the ID. We screen the legal name you submit against international sanctions lists (see Privacy Policy section on Sanctions screening). If your KYC is rejected, you must wait one hour before re-submitting; the rejection reason is shown in the app.

We reserve the right to suspend or terminate accounts that fail to complete verification, that provide false information, or that fail subsequent screening checks.

04 · Section

KYC, AML, and compliance

To comply with the Bank of Ghana Anti-Money-Laundering Act, the Financial Intelligence Centre’s reporting obligations, FATF Recommendations 10 and 16, and U.S. / UN sanctions law (which applies to USDT-on-Tron transactions our infrastructure handles), you must:

  • Provide accurate personal information during registration and KYC.
  • Submit valid government-issued identification documents.
  • Complete KYC verification before any transaction.
  • Update your information if it changes — particularly your legal name, address, or government-ID number.
  • Cooperate with additional verification requests as we determine appropriate based on your transaction volume or risk profile.

4.1 Sanctions screening

We screen the legal name you provide during KYC against the OFAC SDN, UN consolidated, and (where applicable) UK HM Treasury sanctions lists. Screening runs at submit time and again at admin approval. If a confirmed match is found we are required to file a Suspicious Transaction Report with the Financial Intelligence Centre and to freeze the account. We cannot legally disclose to you that this has happened.

4.2 FATF travel rule

For transactions at or above the regulatory threshold (currently GHS 11,700, roughly USD 1,000), FATF Recommendation 16 requires us to collect originator and beneficiary information. At the relevant point of the buy or sell flow we will ask you to confirm whether the destination wallet belongs to you, and if not, to provide the beneficiary’s name, your relationship to them, and the reason for the transfer. Refusing to provide this information will block transactions at or above the threshold but not transactions below it.

4.3 Reporting obligations

Where the law requires it (e.g., Currency Transaction Reports for cash-equivalent transactions at or above GHS 10,000), we file reports with the Financial Intelligence Centre. We do not notify you of individual reports; in many cases the law prohibits us from doing so.

We reserve the right to request additional documentation or information at any time where our risk assessment requires it. Failure to comply may result in account suspension or termination.

05 · Section

Services and transactions

5.1 Buy and sell services

BitPulse facilitates the exchange of USDT (Tether, a US dollar-pegged stablecoin) for Ghanaian Cedis using Mobile Money (MTN MoMo, Telecel Cash, AT Money). We act as an intermediary and do not hold long-term custody of your USDT on your behalf beyond the brief processing window.

5.2 Transaction process

When you place an order:

  • You will receive a quote based on current market rates plus our published spread/fee.
  • The rate is locked at the moment you confirm the order; it is not held indefinitely if you abandon the order.
  • You must complete payment within the timeframe shown in the order detail (typically 30 minutes for buy orders, 7 days for sell orders).
  • We will process your order after payment verification — for buys, after we confirm receipt of your Mobile Money payment; for sells, after the on-chain deposit reaches the required confirmation count.
  • USDT will be sent to the wallet address you provide when you buy. GHS will be paid out to the Mobile Money account you provide when you sell.
  • Sell orders that sit in pending-payment longer than 7 days without an on-chain deposit are automatically cancelled.

5.3 Transaction limits

Each user account has per-order, rolling-daily, and rolling-monthly transaction limits. The exact figures are shown in the app at the time of order and are tied to your account tier and our published platform settings. Default tiers are:

  • Basic tier (default for new verified accounts): GHS 10,000 per rolling 24 hours, GHS 100,000 per rolling 30 days.
  • Pro tier (available on application): higher limits set by us on an individual basis.

We may apply lower per-user limits at our discretion based on risk signals (new account, recent KYC change, unusual location, etc.) and we may revoke or reduce limits for fraud or AML reasons. The limits set out here may be revised at any time to satisfy regulatory expectations.

5.4 Withdrawal address security

When you initiate a withdrawal or sell to a crypto address we have never seen for your account before, the first send to that address is held for 24 hours and you receive an email asking you to confirm. This is a deliberate friction designed to catch account-takeover attempts; we do not bypass it on request. Repeat sends to the same address after the cool-down has elapsed are processed immediately.

5.5 Payment methods

We accept payments via Mobile Money (MTN MoMo, Telecel Cash, AT Money). You are responsible for ensuring your payment method is valid, registered in your own name, and has sufficient funds. Failed or contested payments may result in order cancellation and may trigger AML review of your account.

5.6 Wallet addresses

You are solely responsible for providing correct wallet addresses. On-chain transactions sent to incorrect addresses cannot be reversed and we are not liable for losses resulting from incorrect wallet addresses. We will verify the address format (network prefix, checksum) before broadcasting; we cannot verify that the address belongs to you or to a recipient you intended.

Fees and pricing

Our fees are transparent and displayed before you confirm any transaction. Fees may include:

  • Exchange rate spreads
  • Transaction processing fees
  • Network fees for USDT transfers on supported chains

All fees are clearly displayed during the order process. By completing a transaction, you agree to pay all applicable fees. Fees are non-refundable except as required by law.

Risk disclosure

Trading USDT and digital assets involves substantial risk of loss. Please read this section carefully.

By using BitPulse, you acknowledge and agree that:

  • Stablecoin & peg risk: USDT aims to track USD but can deviate from its peg; issuer, reserve, and market conditions can affect value and availability
  • No guaranteed returns: Past performance does not guarantee future results
  • Regulatory risk: Laws and rules for digital assets may change and affect use or value
  • Technology risk: Blockchain networks may experience delays, congestion, or technical issues
  • Loss of private keys: Loss of wallet private keys may result in permanent loss of funds
  • Irreversible transactions: On-chain transfers generally cannot be reversed once confirmed
  • No insurance: Digital asset holdings are not insured like bank deposits

You should only trade with funds you can afford to lose. We recommend consulting with a financial advisor before engaging in digital-asset trading.

08 · Section

Prohibited activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Engage in money laundering, terrorist financing, or fraud
  • Provide false, inaccurate, or misleading information
  • Attempt to gain unauthorized access to our systems or other users’ accounts
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to violate any third-party rights
  • Create multiple accounts to circumvent limits or restrictions
  • Transfer your account to another person without our written consent

Violation of these prohibitions may result in immediate account termination and legal action.

09 · Section

Limitation of liability

To the maximum extent permitted by law:

  • BitPulse is provided “as is” and “as available” without warranties of any kind
  • We do not guarantee uninterrupted, secure, or error-free operation of the Service
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount of fees you paid to us in the 12 months preceding the claim
  • We are not responsible for losses due to market volatility, technical issues, or user error
  • We are not liable for delays or failures in blockchain network operations

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless BitPulse, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any content or information you submit to the Service

11 · Section

Account suspension and termination

We may suspend or terminate your account, with or without prior notice, if:

  • You violate these Terms or our Privacy Policy.
  • You engage in fraudulent, illegal, or suspicious activity.
  • You fail to complete KYC verification when requested.
  • You provide false or misleading information.
  • We are required to do so by law or regulatory authority (including sanctions or AML enforcement).
  • Your account poses a security risk to other users or to the platform.

11.1 Self-service deletion

You may delete your account yourself at any time from Settings → Security → Delete account. The in-app flow requires you to re-enter your password (and your 2FA code if enabled), and is blocked while you have any pending orders or locked balance (you must complete or cancel those first). On deletion we:

  • Remove your KYC images from storage immediately.
  • Anonymise your personal fields (email, name, phone) on the user record.
  • Delete your payment methods, device tokens, and 2FA secrets.
  • Invalidate all of your active sessions.
  • Send a confirmation email to your pre-deletion email address.

To satisfy our Bank-of-Ghana AML retention obligation, your order, transaction, KYC metadata, sanctions-screening, and audit-log records are retained in anonymised form for five years after deletion. After that retention window, an automated sweep deletes those records too — except where a confirmed sanctions match was found, in which case retention is indefinite as required by law.

Upon termination, your right to use the Service ceases immediately. The provisions of these Terms that by their nature should survive termination (risk disclosure, indemnification, limitation of liability, dispute resolution, governing law) will continue in effect.

12 · Section

Intellectual property

The Service, including its design, text, graphics, logos, and software, is owned by BitPulse and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

13 · Section

Dispute resolution

13.1 Governing law

These Terms are governed by the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.

13.2 Dispute process

If you have a dispute with us, you agree to first contact us at support@bitpulsegh.com to attempt to resolve the dispute. If we cannot resolve the dispute within 30 days, either party may pursue legal remedies.

14 · Section

Changes to these Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered email address
  • Displaying a notice when you log in

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and close your account.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17 · Section

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BitPulse regarding the Service and supersede all prior agreements and understandings.

By using BitPulse, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
