1. Introduction

Welcome to BitPulse ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BitPulse platform, including our website, mobile applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

BitPulse is a cryptocurrency exchange platform that facilitates the buying and selling of digital assets using Mobile Money services in Ghana. Please read these Terms carefully before using our Service.

2. Acceptance of Terms

By creating an account, accessing, or using BitPulse, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Service. By using BitPulse, you represent and warrant that you meet these requirements.

3. Account Registration and Security

3.1 Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Not share your account credentials with any third party
  • Use a strong, unique password for your account
  • Log out of your account when using shared devices

3.3 Account Verification

You must verify your email address and complete Know Your Customer (KYC) verification before conducting transactions. We reserve the right to suspend or terminate accounts that fail to complete verification or provide false information.

4. Know Your Customer (KYC) and Compliance

To comply with anti-money laundering (AML) and counter-terrorism financing regulations, you must:

  • Provide accurate personal information during registration
  • Submit valid government-issued identification documents
  • Complete KYC verification before making transactions
  • Update your information if it changes
  • Cooperate with any additional verification requests

We reserve the right to request additional documentation or information at any time. Failure to comply may result in account suspension or termination.

5. Services and Transactions

5.1 Buy and Sell Services

BitPulse facilitates the exchange of cryptocurrencies (Bitcoin, Ethereum, USDT, and others) for Ghanaian Cedis (GHS) using Mobile Money services (MTN, Vodafone Cash, AirtelTigo). We act as an intermediary and do not hold custody of your cryptocurrencies.

5.2 Transaction Process

When you place an order:

  • You will receive a quote based on current market rates
  • Rates are subject to change until payment is confirmed
  • You must complete payment within the specified timeframe
  • We will process your order after payment verification
  • Cryptocurrency will be sent to your provided wallet address

5.3 Payment Methods

We accept payments via Mobile Money (MTN, Vodafone Cash, AirtelTigo). You are responsible for ensuring your payment method is valid and has sufficient funds. Failed payments may result in order cancellation.

5.4 Wallet Addresses

You are solely responsible for providing correct wallet addresses. Transactions sent to incorrect addresses cannot be reversed. We are not liable for losses resulting from incorrect wallet addresses.

6. Fees and Pricing

Our fees are transparent and displayed before you confirm any transaction. Fees may include:

  • Exchange rate spreads
  • Transaction processing fees
  • Network fees for cryptocurrency transfers

All fees are clearly displayed during the order process. By completing a transaction, you agree to pay all applicable fees. Fees are non-refundable except as required by law.

7. Risk Disclosure

CRYPTOCURRENCY TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. PLEASE READ THIS SECTION CAREFULLY.

By using BitPulse, you acknowledge and agree that:

  • Price Volatility: Cryptocurrency prices are highly volatile and can fluctuate significantly in short periods
  • No Guaranteed Returns: Past performance does not guarantee future results
  • Regulatory Risk: Cryptocurrency regulations may change and affect the value or legality of digital assets
  • Technology Risk: Blockchain networks may experience delays, forks, or technical issues
  • Loss of Private Keys: Loss of wallet private keys may result in permanent loss of funds
  • Irreversible Transactions: Cryptocurrency transactions cannot be reversed once confirmed
  • No Insurance: Cryptocurrency holdings are not insured by any government or private insurance

You should only trade with funds you can afford to lose. We recommend consulting with a financial advisor before engaging in cryptocurrency trading.

8. Prohibited Activities

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Engage in money laundering, terrorist financing, or fraud
  • Provide false, inaccurate, or misleading information
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to violate any third-party rights
  • Create multiple accounts to circumvent limits or restrictions
  • Transfer your account to another person without our written consent

Violation of these prohibitions may result in immediate account termination and legal action.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • BitPulse is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee uninterrupted, secure, or error-free operation of the Service
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount of fees you paid to us in the 12 months preceding the claim
  • We are not responsible for losses due to market volatility, technical issues, or user error
  • We are not liable for delays or failures in cryptocurrency network operations

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless BitPulse, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any content or information you submit to the Service

11. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms or our Privacy Policy
  • You engage in fraudulent, illegal, or suspicious activity
  • You fail to complete KYC verification when requested
  • You provide false or misleading information
  • We are required to do so by law or regulatory authority
  • Your account poses a security risk to us or other users

You may terminate your account at any time by contacting support. Upon termination, your right to use the Service immediately ceases.

12. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by BitPulse and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.

13.2 Dispute Process

If you have a dispute with us, you agree to first contact us at support@bitpulsegh.com to attempt to resolve the dispute. If we cannot resolve the dispute within 30 days, either party may pursue legal remedies.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered email address
  • Displaying a notice when you log in

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and close your account.

16. Severability

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BitPulse regarding the Service and supersede all prior agreements and understandings.
